Please note: These Terms & Conditions are an English translation provided for informational purposes only. The contract language is German. In the event of any discrepancies between the German and the English version, the German version shall prevail (see Section 11).

1. Scope

These Terms & Conditions apply to all orders placed via the Hyperfokus online shop at www.hyperfokus.xyz.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking the order button ("Buy now" / "Pay now"), you submit a binding offer to conclude a purchase contract.

The contract is concluded once we confirm your order by e-mail.

4. Prices and Payment Terms

All prices shown are final prices. In accordance with Section 19 of the German VAT Act (UStG, small business regulation), no VAT is charged and therefore no VAT is shown.

Shipping costs may apply in addition to the prices shown. These are clearly displayed at checkout before the order is completed.

The payment methods displayed at checkout are available (e.g. credit card, PayPal, Klarna).

5. Delivery and Shipping

Our products are individually manufactured after your order is placed (print-on-demand).

6. Retention of Title

The goods remain our property until payment has been made in full.

7. Right of Withdrawal

Consumers are generally entitled to a statutory right of withdrawal.

8. Warranty

Statutory warranty rights apply.

9. Liability

We are liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), and our liability is limited to the foreseeable damage typical for this type of contract.

10. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of Section 36 of the German Consumer Dispute Resolution Act (VSBG).

11. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident abroad, mandatory consumer protection provisions of the law of your country of residence remain unaffected by this choice of law.

The contract language is German. Translations of these Terms & Conditions into other languages, in particular English, are provided for informational purposes only. In the event of any discrepancies between the German version and a translated version, the German version shall prevail exclusively.

Should individual provisions of these Terms & Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
